Terms and conditions
Last updated: October 15, 2026
These terms govern your use of OpicApp (the “platform”). By creating an account or using OpicApp, you agree to them. If you do not agree, please do not use the service. Please read them together with our Privacy policy, which explains how we handle your data.
This English text is a courtesy translation. If there is any difference between it and the Spanish version, the Spanish version prevails.
01Who we are and what OpicApp is
OpicApp is a free platform where people can share photos, short videos and text, keep a private gallery of their own files, and choose exactly who can see each thing. It is operated from Argentina by the OpicApp team (“OpicApp”, “we”, “us”).
OpicApp is at an early stage (MVP). Features may change, appear or disappear as the service grows.
02Who can use OpicApp
- You must be at least 13 years old, or older if the law of your country requires a higher minimum age to use a service like this without a parent or guardian’s consent.
- You must be able to enter into a binding agreement and must not have been banned from OpicApp before.
- If you use OpicApp on behalf of a company or organization, you confirm that you are allowed to accept these terms for it.
03Your account
You can create an account with an email address and a password, or with Google. You must provide accurate information and keep it up to date.
- Your username must have 3 to 20 characters (letters, numbers, dots or underscores). Do not choose a username that impersonates someone else or that infringes someone’s rights.
- You are responsible for keeping your password safe and for everything that happens from your account. Do not share your credentials. Tell us right away if you think someone accessed your account without permission.
- One person, one account. Creating accounts to avoid a suspension, to manipulate likes or followers, or to spam is not allowed.
04Your content and the permission you give us
The content you upload or post (text, photos, videos, comments, messages, your bio and profile images) stays yours. We do not claim ownership of it.
To run the service, you give OpicApp a worldwide, non-exclusive, royalty-free permission to store, copy, process (for example, resize or generate previews), transmit and display your content, only as needed to operate, secure and improve OpicApp, and only according to the visibility you choose for it. This permission ends when you delete the content or your account, except for the short period it may remain in backups and for content other people have already shared or saved.
You promise that you own what you post or have the rights and permissions to share it, and that it does not violate these terms or anyone’s rights, including copyright, privacy and publicity rights. If your content shows other identifiable people, make sure you have their consent where the law requires it.
05Visibility, your private gallery and sharing
Each post can be public (anyone can see it, even without an account), followers only, or private (only you). Your gallery is private to you: files in it are not visible to others unless you publish or share them.
- Public means public: people who can see your content may copy it, download it, take screenshots or share it elsewhere. We cannot control what others do with what you chose to make visible to them.
- Share links give access to a file to anyone who has the link until the link expires or you revoke it. Treat a share link like a key and send it only to people you trust.
- “View once” links are designed to show a file a single time, but we cannot prevent someone from recording or photographing their screen.
- Blurring a folder only changes how its thumbnails look to you. It is a convenience, not a security or privacy feature.
- If you publish a file from your gallery, a new post is created. Deleting the post does not delete the file from your gallery, and deleting the file from your gallery does not delete posts that already use it.
06Content and conduct that is not allowed
You agree not to use OpicApp to post, send or do any of the following:
- Content that is illegal, or that you do not have the right to share.
- Any sexual content involving minors. We have zero tolerance for it: we remove it, close the account, and report it to the competent authorities.
- Sexual or intimate images of a person shared without their consent, or threats to share them.
- Hate speech, harassment, bullying, threats, incitement to violence, or content that promotes self-harm.
- Violent or graphic content published to shock or to glorify harm.
- Sharing other people’s private information (such as addresses, documents or phone numbers) without their consent.
- Impersonating another person or organization, fake accounts, or misleading people about who you are.
- Spam, scams, phishing, unsolicited advertising, or artificially inflating likes, comments or followers.
- Using bots, scraping or other automated means to access OpicApp or extract data from it without our written authorization.
- Trying to get around a block, a suspension, a rate limit, a CAPTCHA, or the visibility settings another user chose for their content.
- Uploading malware, probing or attacking our systems, or interfering with the normal operation of the service.
- Abusing the report system (reporting in bad faith, in bulk, or to harass someone).
Videos are limited to 10 minutes and 50 MB, and images to 10 MB. Supported formats may change over time.
07Reports, moderation and suspensions
Any user can report a post or an account. We review reports and may remove content, restrict features, suspend or delete accounts that break these terms or the law, with or without prior notice, and without notice in serious cases.
Authorized OpicApp staff may access content of any visibility, including private content and messages, when needed to review a report, to enforce these terms, to protect people’s safety, or to respond to a valid legal request. That access is limited to what is necessary.
If you believe we made a mistake, write to us and we will review it. We are not obliged to restore content or accounts, but we will consider your explanation in good faith.
08Copyright and other rights complaints
If you believe content on OpicApp infringes your copyright or another right, send us an email with: (a) a description of the work or right involved; (b) the link to the content; (c) your name and contact details; (d) a statement that you are acting in good faith and that the information is accurate; and (e) a statement that you are the rights holder or are authorized to act on their behalf.
We may remove the content while we review the complaint and may tell the person who posted it. Repeat infringers may have their accounts closed.
09Messages and interactions between users
You can follow, block, like, comment and send private messages. Be respectful. Private messages are private to the people in the conversation, subject to what is said in section 7. We are not responsible for what users say or do to each other, online or offline. Block and report anyone who bothers you.
10Third-party services
OpicApp relies on third parties such as Supabase (database, authentication and file storage), Vercel (hosting), Resend (email delivery), Cloudflare (anti-spam verification) and, if you choose it, Google (sign-in). When you share something to Instagram, WhatsApp or another app, you use that service under its own terms. We are not responsible for third-party services or for how they treat your data.
11Free use and possible paid features
Signing up and using OpicApp is free. In the future we may offer optional paid features (such as tips or creator subscriptions). Basic use of the platform is intended to remain free. If we add paid features, we will explain the price and conditions before you pay for anything.
12No guarantees
OpicApp is provided “as is” and “as available”. We do not guarantee that the service will be uninterrupted, error-free, or free of data loss, or that your content will always be available. Keep your own copy of anything important. We may change, suspend or discontinue features, or the whole service, at any time.
13Limitation of liability
We take reasonable measures to protect the service and your data (see our Privacy policy), but no system is completely secure.
To the maximum extent permitted by law, OpicApp is not liable for indirect, incidental or consequential damages, loss of data, lost profits, or for events beyond our reasonable control, including third-party cyberattacks, failures of our infrastructure providers, connectivity outages, or content that other users post or share. Our total liability for any claim related to the service is limited to the amount you paid us in the last 12 months, or zero if you paid nothing.
Nothing in these terms limits rights that you have by law and cannot be waived, including consumer protection rights where they apply.
14Indemnification
If a third party makes a claim against OpicApp because of something you posted or did, or because you broke these terms or the law, you agree to cover the reasonable costs this causes us (including legal fees), to the extent the claim is due to your conduct and not ours.
15Closing your account and ending these terms
You can stop using OpicApp at any time and ask us to close your account by writing to opicapp2000@gmail.com. We may also suspend or close your account if you break these terms, if the law requires it, or if keeping it open creates risk for others or for the service.
When an account is closed, its content stops being shown on the platform. Copies may remain for a limited time in backups until they are removed in the normal backup cycle, and we may keep specific data when we must do so for a legal obligation or an ongoing investigation. Sections that by their nature should continue after closure (such as content permissions already granted for shared items, limitation of liability, indemnification and governing law) remain in force.
16Changes to these terms
We may update these terms as OpicApp changes. When the changes are important, we will tell you in the app or by email before they take effect. If you keep using OpicApp after the changes take effect, you accept the new terms. If you do not agree, you should stop using the service and may close your account.
17Governing law and disputes
These terms are governed by the laws of the Argentine Republic. Any dispute that cannot be resolved directly between us will be submitted to the competent ordinary courts of the Argentine Republic, without prejudice to any mandatory rights you may have under the law of your country of residence.
18General
If any part of these terms is found to be invalid, the rest remains in force. If we do not enforce a right, that does not mean we waive it. These terms and our Privacy policy are the whole agreement between you and OpicApp about the service. You may not transfer your account or your rights under these terms to someone else; we may transfer ours if the service is transferred to another operator. These terms are written in Spanish and translated into English; if there is any difference, the Spanish version prevails.
